Résumé
Neither the Directive 24/2014 nor the LCSP define concretely the scope and range of the intellectual services. The diverse resolutions of the Tribunal Administrativo de Recursos Centrales allows knowing some of the established limits of what can be consider inside this group. This type of procurements has some characteristics regarding the criteria to be employed in the valuation of offers as established in the article 145 of the LCSP. In this article is briefly analyzed, through a sample of 25 procurement processes, if the legal provisions for this kind of services are fulfilled. The results show that it is still necessary to concede more weight to the quality criteria and that problems may occur when using the open simplified procedure in this kind of services.
