Abstract

Violence at work has generally been considered by Labor Law as something unaccepta-ble. Consequently, it has become a triggering cause for the application of a sanctioning apparatus against such conduct and behavior in the company, under the due application of the principle of proportionality.At the present time, a new sensitivity to one of the most reprehensible variants of violence in the workplace, namely gender-based violence, is emerging with force. Violence against women as a cause or consequence of work is a growing reality, whether under traditional patterns of behavior or under new manifestation caused by the transformations experienced in labor relations. The OIT has promoted a new international instrument to combat violence and harassment at work, specifically including normative categories and legal instruments that prevent, protect and provi-de guarantees to address violence against women.
