Abstract

In its eleventh edition, the Report ‘Labour and Social Security Law in Spain’ offers a summary of the main milestones in labour law over the last year. In the following pages, the experts, members of the Youth Section of the Spanish Association of Labour and Social Security Law (AEDTSS), analyse for you the main judicial pronouncements and legislative developments in a wide range of issues. Firstly, there is a study of issues relating to recruitment and employment, with special reference to the assessment of the three years of application of the 2021 labour reform on contracts and the new EU legal framework on transparency. The analysis goes on to address cases in which non-specific employment rights, such as protection against gender identity, age and disability discrimination, are discussed. Regarding the changes in employment relations, issues such as working time, substantial modifications and geographic mobility are dealt with. Regarding collective law, recurring issues such as the right to strike or ultra-activity are analysed, as well as other more novel issues, such as the tension between the right to information of workers' representatives and data protection regulations, or the implementation of certain protocols without negotiating with the Employee Representation. The section on social protection includes a study of new developments in contributions and the reform of unemployment benefits. In the area of co-responsibility, there can be little doubt that the star topic has been the three-way debate on childbirth and childcare leave in single-parent families. With regard to the prevention of occupational risks, the experts analyse the main case law on issues such as benefit surcharges, occupational illnesses and accidents at work, highlighting those caused by harassment at work, as well as the considerable new regulations, both national and international, in preventive matters. Finally, researchers in the field of procedural law address, among other issues, new jurisprudential developments in relation to the impact of digital technologies on evidence in labour proceedings, the registration of equality plans and, of course, the prior hearing procedure in disciplinary dismissals.
