Abstract

Section 149.3 Constitution orders State Law is suppletory to Regional Law. Constitutional Tribunal judgment (61/1997) said State had no power to aprove suppletory Acts. Most doctrinal arguments had been opposite to these judgment, even saying its breaks Constitutional State. In this paper, after looking those critics, the author explains that judgment is coherence with constitutional power distribution between State and Regional Authorities.
