Résumé
The Constitucional Court did not throw any light on the important legal matters set as a consequence of the Sentence 2/1997 given by the Supreme Court, which sentenced the National Board of Herri Batasuna for the crime of collaboration with terrorist groups, based on the cession of its free electoral media time to the terrorist group ETA. The Constitutional Court used the principle of proportionality to concede the constitutional guarantee. Some important aspects such as the lack of fulfillment of the principle of legality by the crime mentioned above or the exclusion of such behaviour in the article 576 of the Criminal Code, were ignored.
