Résumé
In a democratic State, as the Spanish State, the equality principle of the all spanish people is the main focal point to the democratic régime itself. The infringement of this common and radical condition, that is, the existence of differents citizen’s status, means an important break off a subjective right and, overall, the refusal of the democratic essence of the politic régime.
