Abstract

The analysis upon the figure of legal paternalism, in contrast to free development of personality, with special impact in matter of alien status, specifically, in the figure of the immigrant, carries us to direct the study of this figure on the phenomenon of the immigration for many reasons. It turns out not to be strange the social and political excitement that this matter is raising. Apart from being a topic that has to do with several aspects, the immigration, has to be analyzed in all the aspects in which it affects such as limitation to free development of personality of a person who decided to moved to a different place in order to develop freely his personality, also as civilized, economic, legal and social fact, causing problems of discrimination, integration and xenophobia, and many other aspects.
