Résumé
It is a controversial and complex issue if the Comunidades Autónomas without compiled civil law at the moment in which the Spanish Constitution of 1978 comes into force, have the power to enact valid norms in matters traditionally considered in the field of the Civil Law. In these pages I will approach to the state of the question as seen by the jurisprudence (contradictory) of the Spanish Constitutional Court and the literature.
