Abstract

The recent reform of the road safety offences in the Criminal Law, by the LO 15/2007, intends to avoid �some particular road-violence behaviours with impunity�. In order to achieve this purpose, new types of offence have been introduced, thus reviving the controversy over the risk-crimes in modern Criminal Law. This has become a usual option for the legislator who means to influence on offence prevention conclusively, in this case on the prevention of the increasing number of traffic accidents, which is the most representative phenomenon of the so-called risk society. However, this criminal law reaction implies serious technical complications, being controversial if the same results might be widely achieved by means of the support of resources from other legal sectors, and not by the Criminal Law reform.
