Abstract
The environmental impact assessment (EIA) of projects has been an important goal that has been achieved with great effort. However it has been understood that a number of projects should be excluded from this environmental technic, for instance repair works on infrastructures damaged as a result of catastrophic events, emergency works, national defense or civil protection projects or activities, etc. The Supreme Court decision commented in this research could be the path for a non-restrictive interpretation of the environmental exclusion cases that could endanger the application of the institution of the environmental impact assessment.
