Resumo

En la gestación de sustitución una mujer acepta, por acuerdo, que se le transfiera a su útero un embrión de otra persona o pareja, obtenido tras una fertilización in vitro, llevar ese embarazo a término y entregar al recién nacido después del parto, en sustitución de esa persona o pareja, que serán los padres intencionales. La Sociedad Española de Fertilidad cita que: “Ha de considerarse un recurso excepcional y solo justificado cuando exista en la pareja subrogada o mujer sola subrogada una indicación médica para dicha técnica debidamente documentada o una situación de esterilidad estructural (pareja homosexual masculino y hombre sin pareja), habiéndose agotado, en su caso, otros tratamientos de fertilidad”. De acuerdo con la actual Ley de Técnicas de Reproducción Asistida, no es un procedimiento que pueda desarrollarse en nuestro país. Respecto a los riesgos durante el embarazo de la gestante subrogada, son similares a cualquier otra mujer embarazada, y los resultados perinatales son comparables a los de FIV y donación de ovocitos.
