Abstract
It would have been beneficial for our prehistoric ancestors to live in a social order in which the validity of ethical values deserved general support and was, therefore, communally sustained. It is very difficult to determine to what extent it was so. In any case, what we understand today by rational behavior, judging by the signs th at have reached us, was being defined in those remote moments of our history, because those individuals had to search, by defining strategies and the development of material tools to carry them out, maximum efficiency and productivity of their actions. In this work, starting from relevant palaeoanthropological assumptions, the hypothesis of the ancestral appearance of altruism is raised, while reflecting on the survival of selfishness, trying to expose the ultimate reasons for the perennial confrontation be tween both ethical conceptions. With this I intend to deepen one of the essential aspects of the relationship between ethics and law.
