Abstract

The Spanish Supreme Court has ruled, in two Judgments issued at the end of 2018, that the resulting loss of the qualities of spouse or partner automatically determines the ineffectiveness of those testamentary provisions in which the testator has provided precisely in attention to those qualities, despite the lack of any legal provision in the Civil code about this issue, invoking the analogic application of the art. 767 of the civil code. Notwithstanding this judicial doctrine, the Registry Authority (Dirección General de los Registros) afirms that in registry matters the rule is the validity of the testament regardless the changing circunstances and the imprevision of the testator.
