Resumo

Professional Research on enforcement of environmental protection laws (LPMA) has focused on small (35 Professional or less) and / or a small number of observations in natural environments samples. In addition, usually it studied only discretion, job stress, satisfaction, styles of police intervention and use of force, by you or against you. So scarce studies to investigate the criteria they use these professionals when making the decision to act and the reasons that justify why not intervene in certain cases. In this investigation the criteria used by professionals when starting a record, differentiating between illegal constructions, pollution and transgressions against the environment, and the reasons for not doing so are discussed. They participated in the study 128 professionals working for government agencies with environmental competence in an area of high environmental protection on the island of Tenerife. The results show that the reason given most often to explain why environmental violations are unreported is because it is believed that it is better to educate offenders who report them. Generally speaking, the criteria used to open a file are the same for all three types of transgressions. These criteria tend to be technical-legal and related to the consequences of the fact character, although the percentage varies depending on the type of transgression.
