La ciudadanía Europea en venta. El programa de venta de la nacionalidad maltesa: ¿una brecha en el principio de cooperación leal en el ámbito de ciudadanía de la Unión?

Resumen

¿Cuánto cuesta la ciudadanía de la Unión? Esta pregunta suscitó no poca polémica en el marco del programa de venta de la nacionalidad aprobado por Malta a finales del 2013. La venta directa de la nacionalidad maltesa a nacionales extracomunitarios con un alto nivel de recursos económicos dio lugar a una respuesta sin precedentes por parte de la Comisión Europea y el Parlamento Europeo. El presente estudio examina dicho programa y su relevancia en el diseño actual y futuro de la ciudadanía de la Unión. Igualmente se analiza el nivel de autonomía de los Estados Miembros en la regulación de las causas de adquisición y pérdida de la nacionalidad en el contexto de la Unión Europea. Se realiza también un breve estudio comparativo de los programas de venta de nacionalidad en distintos Estados miembros. La naturaleza de la intervención de la Unión Europea en el programa maltés como precedente legal para evaluar la legalidad de los programas de venta de pasaporte o venta de residencia en otros Estados de la Unión es asimismo objeto de discusión en el estudio. El caso maltés ha puesto de manifiesto la creciente importancia de una serie de principios jurídicos, Europeos e Internacionales, que limitan la discrecionalidad de los Estados miembros en materia de nacionalidad, proporcionando un tertium comparationis con el que evaluar el impacto de sus decisiones sobre la ciudadanía de la Unión. El programa maltés ha venido a subrayar la relevancia del principio general de la Unión Europea de cooperación leal en materia de nacionalidad. Las acciones de los Estados Miembros en este ámbito no pueden afectar negativamente a la esencia del concepto ni a las libertades vinculadas a la ciudadanía europea.
