Abstract
The purpose of this paper is to deal with the legal nature and economic function of the institute of voluntary debt subordination. Particular emphasis is made on the distinction between two levels of the coexistence of claims, one peaceful and the other contentious (especially bankruptcy). With regard to the contentious level, the effect that can be given to these agreements in the formation of classes within a restructuring plan is of particular interest.
