Zusammenfassung
With a view to when the DSA will apply (17 February 2024, although some provisions - the provisions aimed at very large online platforms and search engines - will apply from 16 November 2022, the date of entry into force) and taking into account the foreseeable changes it will bring about in Spanish national law, certain frictions in the future of the liability of digital platforms are already looming. This paper focuses on the study of the “good Samaritan” clause to analyse its compatibility with the safe harbour regime, or lack thereof, and its applicability in the reality of the platform economy and consumer protection of digital services.
