Résumé

These brief notes address a critical review of the collaboration agreement signed between the Hon. City Council of Santa Cruz de la Palma and the Royal Cosmological Society, an agreement defined to implement the collaboration that the Palma socio-cultural institution provides to the local corporation in relation to the public library service of its competence. This examination is focused exclusively on assessing aspects related to its possible legal nature of a subsidy-agreement and its compliance with the General Law on Subsidies and its development regulations. This analysis, moreover, aims to serve as a pretext to examine, on the one hand, the diffuse conceptual lines that separate three frequently used administrative tools, the contract, the agreement and the subsidy, as well as to address issues related to the not always easy accommodation of these agreements to the General Subsidies Law from the point of view of competitive competition in the selection of the individual beneficiary of the instrumented subsidy, and on the other hand, to assess, already in the field of casuistry, to what extent the agreement with the Cosmological Society can be improved from that perspective.
