Abstract

Transnational corporations have the capacity to engage in activities that are harmful to the enjoyment of the human right to a healthy environment. This article seeks to analyze two normative proposals that are currently being developed and to examine how they may represent an improvement in relation to environmentally responsible business conduct. The texts analyzed are the Binding Instrument on Transnational Corporations and Other Business Enterprises currently being negotiated in the framework of the United Nations and the draft Directive on Business and Due Diligence currently being discussed within the European Union. The aim of this research is to analyze the extent to which these policy proposals extend the standard of conduct set out in the UN Guiding Principles and how they establish obligations for companies in environmental matters
